By accessing or using AI Fly Sky ("the Service," "we," "us," or "our"), including our website, applications, and all related services, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

AI Fly Sky is a flight search aggregation and comparison platform. We aggregate flight information from multiple third-party sources, including but not limited to Google Flights, Kiwi.com, Skiplagged, and airlines directly. We use artificial intelligence to analyze and present flight options.

IMPORTANT: AI Fly Sky is a search and comparison tool only. We are not an airline, travel agency, or ticket seller. We do not operate flights, set ticket prices, issue tickets, or guarantee the availability of any flight. All bookings are completed through third-party providers, and your contractual relationship for any purchased ticket is with the respective airline or booking provider, not with AI Fly Sky.

While we strive to provide accurate and up-to-date flight information, we make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, suitability, or availability of any flight information, prices, schedules, or availability displayed on the Service.

Flight prices, schedules, and availability are provided by third-party sources and may change at any time without notice. Prices displayed are indicative and may differ from the final price at the time of booking. We are not responsible for any discrepancies between prices shown on our platform and actual booking prices.

AI-generated recommendations, analyses, and suggestions are provided for informational purposes only and should not be relied upon as the sole basis for travel decisions.

You must be at least 18 years old to use this Service. By creating an account, you represent that you are at least 18 years of age.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at any time, for any reason, without notice or liability.

The Service contains links to and integrations with third-party websites, services, and booking platforms ("Third-Party Services"). These include, but are not limited to:

• Google Flights, Kiwi.com, Skiplagged — for flight price comparison and booking links
• Airlines and other booking providers — for final ticket issuance

We have no control over and assume no responsibility for the content, privacy policies, practices, availability, or performance of any Third-Party Services. Your use of Third-Party Services is governed by their respective terms and conditions. We strongly encourage you to read the terms and privacy policies of any third-party website or service you visit or use.

We are not liable for any loss, damage, or inconvenience arising from your interactions with Third-Party Services, including but not limited to booking errors, payment disputes, flight cancellations, schedule changes, overbookings, or any other issues.

AI Fly Sky may earn commissions or referral fees when you click on links to third-party booking providers and/or complete a booking through those providers. This affiliate relationship does not increase the price you pay. The presence of affiliate links does not constitute an endorsement of any particular provider or flight option.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AI FLY SKY, ITS OWNERS, OPERATORS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, PARTNERS, LICENSORS, AND SERVICE PROVIDERS (COLLECTIVELY, THE "AI FLY SKY PARTIES") SHALL NOT BE LIABLE FOR ANY:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages resulting from your access to, use of, or inability to use the Service
• Damages resulting from any conduct or content of any third party on or related to the Service
• Damages resulting from unauthorized access, use, or alteration of your content or data
• Damages arising from flight cancellations, delays, overbookings, missed connections, or any travel-related incidents
• Damages arising from inaccurate, incomplete, or outdated flight information, pricing, or availability
• Damages arising from errors, bugs, or malfunctions in our AI systems or algorithms
• Damages arising from interactions with third-party booking providers, airlines, or travel services
• Any other damages of any kind, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory

IN NO EVENT SHALL THE TOTAL LIABILITY OF THE AI FLY SKY PARTIES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO AI FLY SKY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the liability of the AI Fly Sky Parties shall be limited to the fullest extent permitted by law.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate, reliable, or complete
• Any errors in the Service will be corrected
• The Service will meet your specific requirements or expectations
• AI-generated content, recommendations, or analyses will be free of errors or biases

You acknowledge that your use of the Service is at your sole risk.

You agree to indemnify, defend, and hold harmless the AI Fly Sky Parties from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any applicable law, regulation, or third-party right
• Any content or information you provide through the Service
• Any travel bookings, purchases, or transactions you make through third-party services accessed via the Service
• Any dispute between you and any airline, booking provider, or other third party

You expressly acknowledge and agree that your use of the Service and any travel arrangements made through or in connection with the Service are undertaken entirely at your own risk. Travel involves inherent risks including but not limited to flight delays, cancellations, personal injury, property damage, and financial loss. AI Fly Sky assumes no responsibility for any such risks.

All content, features, functionality, trademarks, logos, and intellectual property displayed on the Service are owned by AI Fly Sky or its licensors. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without our prior written consent.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Service or its systems
• Use automated means (bots, scrapers, crawlers) to access or collect data from the Service without permission
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service to transmit viruses, malware, or other harmful code
• Engage in any activity that could damage, disable, or impair the Service

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

AI Fly Sky shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, war, terrorism, labor disputes, power failures, internet or telecommunications failures, or third-party service disruptions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration in accordance with the rules of the applicable arbitration authority in the jurisdiction of AI Fly Sky's principal place of business.

CLASS ACTION WAIVER: You agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AI Fly Sky operates, without regard to its conflict of law provisions.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Fly Sky regarding the use of the Service and supersede all prior agreements and understandings.
